Short sale accepted and then outbid - Zillow Real Estate Advice
My wife and I put an offer on a short sale?for $60k buyer paying $3,600 in closing cost. It is a commercial, duplex property. After our offer was accepted the property was left on Zillow for 2 weeks as being available. Another buyer came in with a cash offer for $60k, and the property was removed from Zillow. The seller has said that they are going to submit their offer to the bank at the same time as ours is being considered by the bank. I am a little frustrated because I feel this is a breach of contract on their part, because my offer wasn't given a fair chance to be accepted by the bank, and should never have been accepted if they didn't want to give it a fair chance. The seller noted that if I was able to come up with the cash then they wouldn't have submitted the second offer, but because lending for a commercial property can be tough (even though I have 20% cash available which would be good enough for a commercial loan) they were choosing to push the other offer.
I don't think that there is anything I can do because a short sale is pending the approval of the bank, and when the cash offer is accepted, which is a better offer than mine, my offer is?essentially?declined by the bank. Normally I would just move on to the next place, but multifamily properties don't pop up in the small city I live in very often. I am a first time home buyer.
Is there anything I can do? My?Realtor?has advised me to keep my offer in place on the off chance that the cash buyer pulls out.
